By placing an order on ResinSurplus, you agree to the following Transaction Terms. These terms govern how transactions are processed between buyers, sellers, and the ResinSurplus platform.
1. Platform Role
ResinSurplus operates as a marketplace platform facilitating transactions between independent buyers and sellers of surplus resin materials. ResinSurplus is not the seller of record for listed products unless explicitly stated.
2. Pricing and Fees
Buyer Transactions
When purchasing resin through ResinSurplus:
Buyers are responsible for the full product price listed by the seller.
A processing fee of 12.5% is applied to the product subtotal.
The processing fee covers platform services, transaction handling, and administrative costs.
Processing fees are non-refundable once a transaction is initiated.
Seller Listings
When a seller submits a listing:
The listed product value may be waived for checkout purposes.
Sellers are charged only applicable platform or listing fees, if any.
Seller listings are subject to review and approval per platform policies.
3. Payment Flow and Authorization
Payments are collected at checkout and processed through ResinSurplus’s payment processor.
By completing checkout, you authorize ResinSurplus to collect all applicable charges, including product cost, processing fees, and taxes where applicable.
Orders are not considered complete until payment authorization is successful.
4. Shipping Terms
Unless otherwise stated, shipments are FOB Origin.
Sellers are responsible for preparing goods for shipment.
Buyers are responsible for freight arrangements, shipping costs, and risk of loss once goods leave the seller’s facility.
Shipping addresses must be accurate and complete at checkout.
5. No Returns or Chargebacks
Due to the nature of surplus resin materials:
All sales are final unless otherwise agreed in writing.
Returns, refunds, or cancellations are not guaranteed.
Chargebacks initiated without valid cause may result in account suspension or termination.
6. Seller Representations
Sellers affirm that:
They have legal authority to sell the listed materials.
Listings accurately describe material specifications, quantities, and condition.
Materials comply with applicable laws and regulations.
ResinSurplus is not responsible for inaccuracies in seller-provided listings.
7. Buyer Responsibility
Buyers acknowledge that:
They are responsible for reviewing all listing details before purchase.
ResinSurplus does not guarantee material performance, suitability, or fitness for a particular purpose.
Disputes should first be addressed directly with the seller.
8. Dispute Resolution
ResinSurplus may, at its discretion, assist in facilitating communication between buyers and sellers.
ResinSurplus is not obligated to mediate or resolve disputes.
Legal disputes are governed by the laws of the state in which ResinSurplus operates.
9. Limitation of Liability
To the fullest extent permitted by law:
ResinSurplus shall not be liable for indirect, incidental, or consequential damages.
Total liability shall not exceed the fees paid to ResinSurplus for the transaction in question.
10. Acceptance of Terms
By checking “Accept Transaction Terms” at checkout, you confirm that:
You have read and understood these terms.
You agree to be legally bound by them.
You acknowledge that these terms apply to the current transaction and any future transactions unless updated.
