Marketplace Rules

Applies to: All Buyers, Sellers, Distributors, Producers, and other Users of the Platform.

These Marketplace Rules (“Rules”) define how Users must behave on ResinSurplus.com. The Rules work alongside the Terms & Conditions. If the Rules are violated, ResinSurplus enforces a zero tolerance policy, which may include immediate suspension or termination.

1. Core Principles

  • Accuracy: Listings and communications must be truthful, complete, and not misleading.
  • Professionalism: Treat all Users respectfully; no harassment, threats, or abusive conduct.
  • Compliance: Follow all applicable laws and regulations (safety, environmental, trade, export, etc.).
  • Integrity: No fraud, manipulation, or attempts to circumvent Platform processes or fees.

2. Listing Standards (Sellers)

Sellers must list materials with sufficient detail for a professional Buyer to evaluate suitability. At minimum, a Listing should include polymer/type, grade, form (pellet, regrind, etc.), condition (prime/off-grade/rework), lot size, packaging, location, availability window, and any restrictions.

  • Do not claim certifications, approvals, or properties you cannot document.
  • Disclose known issues (contamination risk, mixed lots, off-spec conditions, unusual odors, moisture, etc.).
  • Images and documents (COA, SDS) must be authentic and relate to the listed lot when provided.
  • Do not list illegal, restricted, or prohibited materials.

3. Buyer Responsibilities

  • Perform your own qualification, testing, and due diligence prior to purchase.
  • Confirm specifications, packaging, and logistics constraints before issuing purchase orders.
  • Ensure you are authorized to purchase and import/receive the material in your jurisdiction.
  • Pay according to the agreed terms; do not initiate chargebacks in bad faith.

4. Communications and Conduct

  • No harassment, hate speech, or discriminatory conduct.
  • No coercion, threats, or extortion.
  • No sharing of another User’s confidential business information outside a Transaction.
  • No spam, phishing, malware, or solicitation unrelated to material Transactions.

5. Pricing, Offers, and Negotiations

  • All pricing and availability statements must be made in good faith.
  • Do not bait-and-switch (advertise one lot/price then attempt to substitute materially different terms).
  • If a listing is no longer available, promptly update or remove it.

6. Payments, Title, Shipping, and Risk of Loss

ResinSurplus is not a payment processor or escrow provider unless stated in a separate written agreement. Buyer and Seller are responsible for negotiating payment terms and selecting carriers and Incoterms (or equivalent).

  • Sellers must package and label shipments safely and lawfully.
  • Buyers must provide accurate delivery instructions and receive shipments timely.
  • Any disputes regarding shortages, damage, or quality must be addressed between Buyer and Seller under their agreed terms.

7. Prohibited Activity (Zero Tolerance)

  • Fraud, misrepresentation, forged documents, or deceptive practices.
  • Stolen goods or materials offered without legal authority to sell.
  • Attempting to defeat security measures, scrape restricted data, or disrupt Platform operations.
  • Circumventing applicable Platform fees through off-platform side arrangements initiated on the Platform.

8. Distributors and Producers

Producers and distributors may operate under negotiated commercial terms and may have additional onboarding requirements (data feeds, compliance attestations, contractual documentation). These negotiated terms do not reduce baseline obligations under the Terms & Conditions and these Rules.

9. Enforcement

ResinSurplus may investigate suspected violations and take action at its sole discretion.

  • Warning and remediation request (optional)
  • Listing removal or temporary restriction
  • Account suspension
  • Account termination
  • Referral to law enforcement where appropriate

10. Reporting Issues

Users should report suspected fraud, misrepresentation, or other violations via the contact methods on the Platform. Provide relevant details (listing URL, messages, documents, order references).
